Single supplier - intellectual property or exclusive rights

The contracting authority justifies this direct award pursuant to Schedule 5, Paragraph 6(a) and 6(b) of the Procurement Act 2023. The manufacturer has confirmed that the appointed supplier holds exclusive rights to supply the specific operating table system and associated proprietary accessories required to meet the Trust's clinical and technical requirements. As a result, competition is absent for exclusive rights reasons and no reasonable alternative or substitute exists.

Barking, Havering and Redbridge University Hospitals NHS Trust (BHRUT) is making a direct award for three operating tables to ensure standardisation at the King George Hospital (KGH) site. The Trust already operates three identical units at this location.

A change in supplier would result in significant technical incompatibility and unacceptable clinical risk. Specifically:

1) Existing proprietary accessories (including headrests, stirrups and table extensions) are not interchangeable with alternative manufacturers' systems.

2) The introduction of additional platforms would create disproportionate technical complexity and maintenance burden for Medical Engineering (EBME).

3) Clinical risk would be increased, as introducing a different user interface for identical surgical procedures heightens the risk of operator error for staff working across the theatre suite.

Accordingly, this direct award is lawful under Schedule 5, Paragraph 6 of the Procurement Act 2023.
