This exercise relates to the use of the negotiated procedure with identified providers of secure accommodation for children and young people in Scotland who hold the necessary authorisations or memberships required in Law (as detailed in III.2). Notwithstanding that Regulation 75(2) of the Public Contracts (Scotland) Regulations 2015 (the “Regulations”) applies to this exercise, Scotland Excel has elected, voluntarily, to place this notice for reasons of transparency. The negotiated procedure has been developed in accordance with Regulation 76(8) of the Regulations.

Providers must not be excluded from participation based upon a mandatory exclusion referred to in the Regulations 58(1) and (3).
Participation is reserved to a particular profession as set out in III.2.1.
Requirements apply to staff responsible for performance as set out in III.2.2
Suitable insurances require to be held for the Services as detailed in the conditions of contract.
Providers will demonstrate to Scotland Excel’s satisfaction that they possess the necessary economic and financial capacity to perform the contract.
three.2) Conditions related to the contract

Authorisations and registrations are required as follows:
♦ Approval by Scottish Ministers under the Social Care and Social Work Improvement Scotland (Requirements for Care Services) Regulations 2011 for accommodations to be provided for the sole purpose of restricting the liberty of children in residential premises where care services are provided.
♦ Registration in accordance with the Education (Scotland) Act 1980, as amended, with the Registrar of Independent Schools.
♦ Registration with the Social Care and Social Work Improvement Scotland (“Care Inspectorate”) as the provider of a secure accommodation service under the Public Services Reform (Scotland) Act 2010.

Staff performing the contract must be registered with the relevant regulatory bodies in Scotland governing their profession and vetted in accordance with the Protection of Vulnerable Groups (Scotland) Act 2007.

A price-quality ratio of 40% Price – 60% Quality will be applied to the services offered.

This Contract Notice is being issued for transparency and not as a call for competition.
A negotiated procedure will be entered into with the identified providers of this Service to award separate and distinct contracts in accordance with Regulations 33 and 74-76 of the Public Contacts (Scotland) Regulations 2015.
The Duration at II.2.7 is a maximum period applicable to each contract and is proposed to comprise: an initial period of 36 months with options to extend for up to a further 24 months in increments to be determined by Scotland Excel and agreed by the Provider.
The exercise of any extension option will be at Scotland Excel’s discretion and will take account of emerging policy requirements and commercial considerations.
