Award of a contract without prior publication of a call for competition in the cases listed below
- The procurement falls outside the scope of application of the regulations
Explanation:
Due to operational and safety requirements at Oban, vessels require to use fuel storage tank facility exclusively owned and operated by Certas Energy UK Ltd t/a Scottish Fuels.
As vessels provide a lifeline service to the islands there must be no impact on traffic movements including loading/discharge on the pier or port area, and the function of the ship can continue while taking bunkers, it does not impact on any vessel operations.
Using fuel storage tank eliminates congestion and safety issues on pier when bunkering with Oban being a heavily pedestrianised site.
With plans to close Oban berth 1 in Summer 2028 (within this Agreement) due to CMAL Upgrading Oban 1 Berth, closing Oban berth 1 will lead to further congestion and operational difficulties with all major vessel operating at the one berth (berth 2).
