The requirement fits within the Defence and Security Contract (D&SC) Regime of Procurement Act 2023, Part 1, Section 7 (1) (a) military equipment, (b) sensitive equipment, (c) goods, services or works necessary for the development, production, maintenance or decommissioning of military equipment or sensitive equipment, & (f)
sensitive services or sensitive works.
The current Fleet contains proprietary equipment to the proposed Supplier - Schedule 5, section 5 (a) & (b).
It would not be practical or an efficient way of working to remove any equipment prior to and subsequent to any works tasked under this contract - Schedule 5, section 6 (a) & (b).
It is also required to keep Fleet Standardisation, interoperability and compatibility.
Schedule 5, section 20 (a), (b) & (c) applies - MOD is a defence authority; the contract will be a defence and security contract by virtue of Part 1, Section 7 (1) (a), (b), (c) & (f); and, it is necessary for the contract to be awarded directly in order to enhance or maintain the operational capability, effectiveness, readiness for action of specific element of the armed
forces.
