two.2.4) Description of the procurement

NHS Cheshire & Merseyside ICB - Liverpool Place has awarded this contract on the grounds of urgency for the provision of specific, complex support required to enable feeding for a patient currently within a local acute hospital upon discharge to local placement arrangements within a community setting. The patient is currently subject to Court of Protection oversight and frequent court rulings.

The support required includes administering feeds twice per day as part of a structured feeding plan under clinical supervision using the least restrictive methods of restraint. The Individual requires intensive interventions as part of their discharge plan which needed to be mobilised quickly and safely.

The Contract has been awarded for an initial period of 6 months (22nd September 2025 to 21st March 2026) with an option to extend for a further 6 months (21st August 2026).

six.3) Additional information

This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of

doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.

This urgent contract award is to ensure the individual is moved to a more appropriate setting to meet their highly complex needs and supports a safe discharge plan. The current setting (hospital) is deemed by mental health and physical health clinicians to be more harmful and impacting negatively on their mental health. The Individual requires intensive interventions as part of their discharge plan which need to be mobilised quickly and safely. This plan has been subject to Court of Protection hearings.

Decision-making with regards to this patient and associated contracts has been undertaken by C&M ICB (Liverpool Interim Place Director and Associate Director of Quality & Safety Improvement) and Social Care Senior Directors as part of a Complex Cases Panel informed through the local Commissioners and wider Multi-Disciplinary Team supporting the Individual's care.

There have been no conflicts of interest declared at any stage of decision-making and contract award process.
