Description of risks to contract performance
The Contracting Authority acknowledges that certain risks associated with the procurement and operation of a cage washer system may not be fully quantifiable at the time of tender. In addition to identified risks-such as technology evolution, integration challenges, supply chain disruptions, software lifecycle changes, increased scope due to demand, regulatory shifts, and operational continuity, other potential known/unknown risks include user adoption and training challenges, future environmental compliance requirements, intellectual property and licensing constraints, evolving cybersecurity threats, contractual interpretation risks, market volatility, end-of-life planning, ethical sourcing concerns, and resilience to force majeure events. Suppliers will be expected to demonstrate adaptability in responding to emerging issues throughout the contract lifecycle.
Whilst it is not possible at this stage to fully anticipate the nature or extent of future developments or integration requirements, nor to determine their potential impact on contract performance, the Contracting Authority recognises that such changes may arise over the course of the contract. Accordingly, it is acknowledged that these circumstances may necessitate a modification of the contract to appropriately address and accommodate any emerging risks or requirements.
