The Barnet Podiatric Surgery Service provides medical and surgical management of foot pathology within the outpatient and theatre setting.

The service also provides a theatre list is for day cases only, carried out under local anaesthetic. In rare occasions, the service provides podiatric surgery under general anaesthetic.

The service is commissioned to treat patients who are registered in with a Barnet GP and receives referrals for forefoot conditions from GPs and Podiatrists.

two.2.4) Description of the procurement

This notice is confirmation of an award having been made due to an urgent circumstance.

The contract will enable the Relevant Authority use of their theatre Space, theatre staff and consumables. This will enable the Relevant Authority to continue to deliver podiatry surgery operations for patients registered with a Barnet GP who are currently on the waiting list for surgery.

The aim is to continue to run 21 full day local anaesthetic theatre lists a year with 6-8 patients per list (maximum of 8 patients determined on a staffing levels/time per case basis) from Chase Lodge Theatre Space.

The Relevant Authority needed to act urgently and award a new contract for the services as the existing Provider served notice to the Relevant Authority and the services became unavailable.

The value of the contract is £176,540.00 exc VAT for each six month period, however if theatres are cancelled with the correct notice period, the Relevant Authority reserves the right to only pay for the session that are used.

The dates which the services are to be provided is from 25th September 2025 for a period of 6 months. The contract term may be extended by a further 6 months.

Explanation:

A contract award notice (confirmation) has been made in accordance with PSR Regulations 14(1), 14(2) and 14(4), contracts can be awarded under the Urgent awards or contract modifications under the PSR legislation for the below reasons with a focus on the risks to patient and/or public safety if these awards are not made:
Where a relevant authority considers that—
(a) an award or modification must be made urgently; and
(b) the reason for the urgency was not foreseeable by and not attributable to the relevant
authority; and;
(c) delaying the award of the contract or modification to satisfy the requirements of regulations 6 to 13 would be likely to pose a risk to patient or public safety,
The relevant authority considers all the above applies and therefore may make urgent award.

six.3) Additional information

- This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 and the Procurement Act 2023 do not apply to this award.

- The reason for the urgency was not foreseeable by and is not attributable to the Relevant Authorityjustification as to why this award was made under an urgent circumstance. Any delay in award of a contract to conduct a full application of the PSR would be likely to pose a risk to patient safety.

- The contract length is 12 months.

- The Relevant Authority's governance/decision-making panel are making the award decision.

- Contract value £176,540 for the initial 6-month period.
