Description
Redcar & Cleveland Borough Council are establishing a Framework Agreement to provide Waste Haulage Services. The framework involves hauling various types of waste from identified collection sites to identified delivery sites as instructed by the Council using appropriate vehicles and drivers which the successful organisation must supply.
The Framework involves the appointment of up to 3 suppliers.

Framework operation description
Award of individual Call-off contracts under the Framework Agreement will be made on a ranking basis. The tenderer ranked in first position will be approached with all requirements in the first instance. If they are unable to meet the requirements within the required time frames, the second-ranked organisation will be approached, and so on.

Description of risks to contract performance
Fuel cost fluctuation has been identified as a known-unknown risk within the delivery of waste haulage services under this Framework.
To ensure that framework pricing remains commercially sustainable over the Framework period, the council has built in a price review mechanism whereby framework prices shall be reviewed every six months, as detailed within the Tender documents.
In addition, and in accordance with the Procurement Act 2023, Schedule 8, paragraph 5, the Authority reserves the right to consider modifications to framework pricing where there is a significant and demonstrable change in fuel costs that materially affects the viability of service delivery. Any modifications will be subject to the requirements of the Procurement Act.

Justification for not publishing a preliminary market engagement notice
The Contracting Authority has carried out preliminary market engagement in relation to the contracting opportunity. The preliminary market engagement was conducted prior to the commencement of the Procurement Act 2023 which is why a preliminary Market Engagement Notice was not published.
An online session was held on 15th January 2025, with a presentation. The opportunity advertised openly to suppliers on the Contracting Authority's previous e-tender system (ProContract). The slides from the market engagement presentation are included in this tender pack for information.
