Description

In 2024 Gloucester City Council undertook and completed a regulated Procurement, in accordance with The Public Contracts Regulation 2015,to procure a Managed Leisure Services supplier. The successful supplier's submission included a proposal, in response to the Councils requirements, for the provision of physical improvements to our Leisure Centres.

The successful tenderer cited their appointment of Clarkson Alliance Ltd (the Supplier), as their agent to project manage the capital improvement and energy efficiency works. This appointment was made in recognition of the established working partnership, including the delivery of over 50 leisure projects across the UK.

Accordingly, the Supplier supported their tender proposal, that included designs and schematics together with a plethora of other key documents. The tender evidenced their substantial knowledge of the required works, leisure centre development and revitalisation, and the Managed Leisure supplier's ways of working and associated values.

Since the award of the Managed Leisure Services Supplier it has been identified that it will be more cost effective to the Project for the Council to contract Clarkson Alliance to carry out the activities it was to perform for the Managed Leisure Supplier. The services to be provided to the Council includes

• assistance with the procurement of contractors and the professional team by the Council including the preparation of the scope of works/services and preparing the contracts

• undertaking the role of project management and supervisor under an NEC construction and engineering contract

Consequently, success of the project, in regard to maintaining and managing both the critical timescales and budget, requires the continued support and services of the Supplier, who are best placed to deliver and continue the work commissioned to date by our Managed Leisure supplier, noting that the Supplier has the associated, knowledge and intellectual property that is invaluable to the success of the project.

Gloucester City Council have published this Transparency Notice, in accordance with Section 41 Direct award in special cases, and the associated conditions in Schedule 5 (which are detailed below) of the Procurement Act 2023.

The information below verifies that Gloucester City Council have met the following conditions:-

Schedule 5: - The following conditions are met in relation to the public contract-

(a) due to a particular supplier having intellectual property rights or other exclusive rights, only that supplier can supply the goods, services or works required, and

(b) there are no reasonable alternatives to those goods, services or works.

A competitive procedure for these services, would require repeated designs and associated information that would not only be detrimental to the project's timescales, but impact public monies with activities needing to be replicated incurring further costs.

Therefore, there is no reasonable alternative to the provision of these services and Gloucester City Council are looking to appoint and enter into a contractual agreement with Clarkson Alliance Ltd, to fulfil and deliver the project goals, that will be of benefit to our residents.
