seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The Contract Modification Notice is published to notify of the extension of the contract by an additional 6 months resulting in an estimated uplift to the contract value of £90,000 excluding VAT.
seven.2.2) Reasons for modification
Need for additional works, services or supplies by the original contractor/concessionaire.
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
An extension of the contract has become necessary due to the impact of unexpected data quality issues on implementation and initial testing, and unexpected delays in establishing processes to analyse and use the output data. These delays have led to the need to extend the 14-month term of the contract for a further period of 6 months, so that there is enough output data to enable meaningful evaluation of the extent to which the trial has been successful.
A change of contractor cannot be made due to the technical, non-interchangeability of the data range and matching approach that would be offered by a new supplier when compared with the methodology of the incumbent supplier, which would necessitate the start of an entirely new trial and, as such, would lead to substantial duplication. Furthermore, such an approach would result in the contract spend to date becoming wasted costs.
If the contract were to be re-tendered, this would also result in significant inconvenience given the time and resources that would be required by the Department in running a new procurement process, completing any relevant security and governance requirements, onboarding any new supplier and then re-running the pilot from the beginning. This would also substantially duplicate the cost of the contract originally procured.
The estimated increase in the value of the contract is £90,000 excluding VAT over the initial contract value of £274,720 excluding VAT, and therefore the increase to the contract value is less than 50% of the contract as estimated on award.
