Description of risks to contract performance
Operational Risks • Service delivery failures: Missed or delayed statutory inspections (e.g., fire safety, gas, electrical) can lead to non-compliance and safety hazards • Reactive repairs delays: Slow response times to urgent repairs may disrupt school operations and pose health and safety risks • Poor contractor performance: Inadequate workmanship or lack of qualified personnel can compromise service quality and trust reputation Financial Risks • Budget overruns: Unexpected costs from reactive repairs or inflationary pressures can exceed allocated budgets • Insufficient reserves: Many trusts are operating with minimal financial buffers, increasing vulnerability to emergency costs • Contractor insolvency: Financial instability of suppliers may lead to service disruption or contract termination. Strategic Risks • Staffing pressures: High turnover or lack of skilled staff within the trust or contractor can affect oversight and delivery • Estate condition: Poor baseline condition of buildings may lead to higher-than-expected servicing and repair needs • Growth constraints: Limited capacity to expand or adapt services due to financial or resource limitations Compliance & Governance Risks • Regulatory breaches: Failure to meet statutory obligations (e.g., under the Health and Safety at Work Act 1974) can result in legal action or funding consequences • Data protection: Contractors handling sensitive information (e.g., site access logs) must comply with GDPR • Risk register gaps: Inadequate identification or monitoring of risks at board or local level can lead to oversight failures External Risks • Extreme weather: Flooding, storms, or heatwaves can damage infrastructure and increase reactive repair needs • Supply chain disruptions: Material shortages or transport issues can delay servicing and repairs • Policy changes: Shifts in government funding or procurement rules may affect contract scope or viability
