Description
The Authority is seeking to procure the second generation of rehabilitative services for men in prison or the community to help them address rehabilitative needs and to desist from offending, across England (other than Greater Manchester, where a procurement for similar services will be led by GM Combined Authority) and Wales.
The budget for the men's services is £854,446,831.86 (inc. VAT) for the full term of the contracts (optional extensions included), final values will be confirmed once the spending review and governance is completed. There is an indicative launch date of September 2025, an indicative award date of October 2026 and an anticipated indicative go live date of March 2027. The proposed contract length shall be 5 years, with the option to extend by up to 3 further years. Please note, that all key decisions including budgets, contract length and dates are yet to be approved through internal governance and therefore may change.

Payment terms
Subject to the relevant provisions of the Contract, the Funding Partner will must pay the Delivery Partner the Charges:
- before the end of the period of thirty (30) days beginning with the day on which an invoice is received by the Funding Partner in respect of the sum; or
- if later, by the date on which the payment falls due in accordance with the invoice,
subject to the invoice being verified by the Funding Partner as valid and undisputed; and
- in cleared funds using the payment method and details stated in the invoice or in the Award Form.
- A Delivery Partner invoice is only valid if it:
- includes the minimum required information set out in section 68(9) of the Procurement Act 2023;
- includes all appropriate references including this Agreement reference number and other details reasonably requested by the Funding Partner; and
- includes a detailed breakdown of delivered Services and Milestone(s) (if any).
The Delivery Partner will include a clause in all sub-contracts requiring payment of all sums due to Supply Chain Partners within no more than thirty (30) days of receipt of the invoice received from a Supply Chain Partner.
The default requirement will be for the Delivery Partner to use the Funding Partners e-invoicing system.
All invoices will be paid in GBP by electronic transfer of funds to the bank account that the relevant Party has specified on its invoice.
Description of risks to contract performance
In line with Section 74 and Schedule 8 of the Procurement Act 2023, and recognising that this is a light touch contract, the Funding Partner has prepared a list of Known Risks which, at the time of publication, are accurate and relevant. These are available below:
Inflation - High CPI Impacting Contract Viability:
Unexpected increases in the Consumer Price Index (CPI) may significantly raise the cost of delivering contracted services, potentially rendering the contract financially unviable over time. This risk doesn't change the position and mechanism provided in the ITT and contract documentation and this method should be applied when modelling the solution and which may result in a change of scope and/or contract value.
Departmental Reprioritisation:
There is a risk that changes in government policy, ministerial priorities, or funding allocations particularly following a General Election, departmental restructuring, or HM Treasury spending reviews may significantly impact the delivery of probation services. This includes potential shifts in focus between custodial and community-based interventions, changes to the Integrated Offender Management (IOM), or the introduction of new rehabilitation programmes (e.g. through the Reducing Reoffending Delivery Plan), resulting in a change of scope and/or contract value.
Co-commissioning Mid-contract:
There is a strategic risk associated with the need to introduce co-commissioned services during the lifetime of the contract to maximise outcome for service users across multiple public sector organisations. The current commissioning may not be sufficiently flexible to accommodate new or evolving partnership arrangements once the contract is underway, resulting in a change of scope and/or contract value.

Contracts will be competed through a competitive flexible procedure, following a three-stage tender process of written tender responses.
Stage 1 - Procurement Specific Questionnaire
The Procurement Specific Questionnaire (PSQ) is a set of questions that a Bidder must satisfy to be able to go to the next stage of this procurement. These questions will relate to the Bidders legal and financial capacity as well as their technical ability.
Bidders will indicated which of the 27 lots they wish to be invited to tender for in this stage.
After outcome letters, bidders who passed all of the PSQ stages will be invited to Stage 2.
Stage 2 - Invitation to Tender
Suppliers who successfully pass Stage 1 PSQ shall be invited to Stage 2 ITT
For this stage, the procurement process shall compete 27 separate Lots, which will result in a maximum total of 27 separate Contracts. The Lots shall be competed in two separate competition waves as outlined in the procurement description.
The tender documents shall contain quality questions, and financial response template, along with a draft contract and associated schedules which require a written tender response for each Lot respectively.
Stage 3 - Preferred Supplier Stage (optional)
Once the evaluation and moderation for both Tender waves is completed, the Funding Partner will review the current indicative timeline and assess whether a Preferred Supplier Stage can be conducted in full, in a comprehensive and efficient manner for both parties.
If the Funding Partner deems there is sufficient time to conduct this, they shall notify Suppliers and shall conduct in an indicative timeframe of 20 working days (subject to change).
If enacted, the Preferred Supplier Stage will cover the following:
Contract Finalisation - ensure all contractual provisions are clearly understood and agreed in line with the terms set out in the procurement process.
Mobilisation Planning - agree key activities, responsibilities and timelines ahead of commencement of the contract.
Mitigating Reservations - the purpose of these discussions is to reduce, mitigate or remove the risk caused by reservations that may arise during the contract term. It is not permitted as part of these discussions to alter the bid in a material way that would have changed the result of the tender process.
