Award of a contract without prior publication of a call for competition in the cases listed below

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

This approach is considered justified and aligned to the Procurement Reform (Scotland) Act 2014, which states that Public Sector Organisations may award a contract without seeking offers, considering the principles of procurement where relevant. In this instance, there was no suitable supply market that the Council could access within the required timeframe. This method of award will mitigate the risk of a gap in delivery of the services, minimising the impact on the supported young people and families. The approach also takes into consideration that a sudden change in provider would not allow for an effective transition which may be disruptive and damage the relationships that have been established with the young people and families.
