Award of a contract without prior publication of a call for competition in the cases listed below

  • The procurement falls outside the scope of application of the regulations

Explanation:

National Highways require the services to operation diagnostic software packages known as MOTE and Tester. These are essential for the maintenance, commissioning and testing of Signals, Message Signs and Midas Outstations. The distribution access to these licences is to more than 200 + users, which include Maintain & Repair suppliers which require use of these tools daily for maintenance works. There is no alternative to this process in the short term. Without these services the Roadside Technology Availability KPI is at risk and with additional costs incurred due to increase of time and materials.

Historically, there have been two failed procurements to develop new software on up-to-date tools; this is due to the cost being too high when the tenders were returned.

four.1.8) Information about the Government Procurement Agreement (GPA)

The procurement is covered by the Government Procurement Agreement: No
