two.2.4) Description of the procurement

The Air Commodities Delivery Team (ACDT) within Defence Equipment & Support (DE&S), part of the UK Ministry of Defence, (“the Authority”) intends to award a Contract to Helmet Integrated Systems Ltd for the procurement of Post Design Services, Spares and repairs for Helmets, Ground Use Headsets, In Ear Communication Devices (IECDs) and Test Equipment for use on air platforms.

The current contract for Post Design Services, Spares and Repairs of Helmets and In-Ear Communication Devices (IECDs) will expire on 31 December 2024. There is an ongoing requirement to continue to support this equipment until 2032, which will comprise of five (5) year contract with three (3) option years of twelve months each at an estimated value of £31.2M.

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons.

The Authority has insufficient intellectual property rights to the modifications to the equipment and is therefore unable to pass the necessary data and information to undertake the requirement to third parties. Only the extant Contractor is the approved Design Organisation (DO) for the articles and owns the Design Rights for the articles which fulfil the requirement.

This technical expertise, together with the ownership of the Design Rights, means that no company other than Helmet Integrated Systems Ltd can carry out the activities required in the time frame specified by the Customer.

Helmet Integrated Systems Ltd hold the necessary Design Approved Organisation Scheme accreditation to meet Airworthiness requirements with Military Aviation Authority (MAA) regulations ensuring continued support of this equipment to the required safely levels.
