Explanation:

The A400M Delivery team, part of the UK Ministry of Defence, intends to place an 18-month contract with Leonardo UK for support to de-risking and advancement activity in relation to the integration of an Electro-Optical/Infra-Red Defensive Aids System (EO/IR DAS) onto the A400M platform.

In accordance with Regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450).

It is considered that this contract can be placed using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 for technical reasons.

OCCAR, on behalf of the UK MOD, have contracted a tasking with Airbus Military Sociedad Limitada (AMSL) as the A400M platform Design Organisation, for de-risking and advancement activity relating to the integration of a new EO/IR DAS system onto the A400M; such system being manufactured by Leonardo UK. In order to be able to complete the work under this contract, there is a dependency for the UK to provide equipment-specific information including interface requirements. The equipment OEM, Leonardo UK, is the only contractor with access to this information and specific know-how.
