Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

There is justification under Regulation 33 - Negotiated Procedure Without Prior Publication, of the PCS (Scotland) Regulations 2015, in which to directly award this requirement on the basis of Reg 33 (1) (c) where (but only if it is strictly necessary) for reasons of extreme urgency brought about by events unforeseeable by the contracting authority, the time limits for open procedure, restricted procedure or competitive procedure with negotiation cannot be complied with. The events unforseeable were that the University of Strathclyde's current provider of these services (Carlton Carbon Ltd (13282768)) have defaulted on their contract with the contracting authority, and will no longer purchase carbon allowances on its behalf. Considering that the current rates for these carbon allowances are at considerably low levels, the University of Strathclyde urgently needs to purchase these now in an effort to reduce the potential costs if they increase again. It should also be noted that the University of Strathclyde is in adherence with Reg 33 (3) - For the purposes of paragraph (1)(c), the circumstances invoked to justify extreme urgency must not, in any event, be attributable to the contracting authority, as Carlton Carbon Ltd (13282768) defaulting on their contract with the University of Strathclyde is not attributable to them as the contracting authority.
