Explanation:
The Ministry of Defence (MoD) intends to award a contract to BAE Systems (Operations) Ltd for the supply of Aircrew Equipment Assembly Equipment (AEA) with an estimated value of £420,000 excluding VAT.
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this contract is regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons. This is because only BAE Systems can meet the MoD’s necessary timescales to provide the AEA equipment, avoiding capability gaps in this critical service. All equipment used on the Hawk Mk 167 Air System must first undergo a rigorous clearance process and be approved for inclusion within the Hawk Mk 167 Military Permit to Fly (MPTF) by the Hawk Mk 167 Type Airworthiness Authority. While equipment from other suppliers could be added to the MPTF, the clearance process takes in excess of 12 months and therefore undertaking this activity for new AEA equipment from other suppliers would result in strategic programme failure in delivering sufficient AEA for the Qatar Hawk programme.
