NGN have in place a Professional Services framework that it utilises for the provision of specialist contractors. On some occasions the right resource is not always available at the right time and as such NGN need to look elsewhere to locate certain specialists. This notice relates to NGN's ongoing relationship with a provider of commercial specialists. NGN has been engaging with this organisation over the past two years on an ad hoc basis and with the contract just awarded for the services of an additional individual, the spend thus far is circa £500K which is above the procurement threshold. It should be noted that in addition to the Professional Services framework NGN is in the process of establishing a further "recruitment" framework which will make such occurrences less likely in the future.

Explanation:
The value of the contracts awarded to the supplying organisation on an ad-hoc basis is now at a value that is above the procurement threshold hence this notice. NGN is addressing this situation by establishing a further recruitment framework which should avoid such publications in the future. The requirement complies with regulation 50 (1) Utilities may use the negotiated procedure without prior call for competition in the following cases- (f) for new works or services consisting in the repetition of similar works or services assigned to the contractor to which the same utility awarded an earlier contract, provided that such works or services conform to a basic project for which a first contract was awarded following a procedure in accordance with regulation 44(1) and (2);
