The authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further information from the contracting authority before the contract is entered into.

Such additional information should be requested from the addressee found in I.1. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations 2015 (SI 2015 No 102) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (within 30 days beginning with the date when the economic operator first knew or ought to have known that grounds for such action had arisen).

Where a contract has not been entered into the court may order the setting aside of the award decision or order the authority to amend any document and may award damages. Following the correct implementation of a10 day standstill period and publication of appropriate notices the court may only award damages once the contract has been entered into.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The Council has created an additional two categories for the Employment and Skills DPS. These two new categories are:

1. Communities and Place

This category applies to increasing engagement to increase community involvement and cohesion. It also applies to building resilient, healthy and safe neighbourhoods. This will predominantly involve revenue related activities with a small amount of capital. Examples include but not limited to:

• Delivering community led projects to address needs identified by communities

• Improving community infrastructure such as digital inclusion and volunteering

• Improving local green space for communities to enjoy

• Enhancing physical, cultural and social ties at a neighbourhood level

• Delivering activities for crime prevention

• Improving the built and natural environment in specific neighbourhoods

• Improving community engagement and involvement to help improve local neighbourhoods

• Provision of advice services such as money and budgeting services and debt advice

2. Business Innovation and Growth Sectors

This category applies to creating jobs and boosting community cohesion, promoting networking and collaboration, and increasing private sector investment in growth enhancing activities. The category will also involve exploiting opportunities in growth sectors. This will predominantly involve revenue related activities with a small amount of capital. Examples include but not limited to:

• Start up business support

• Improvements to local retail, hospitality, and leisure sector activities

• Bringing together businesses within and across sectors to share knowledge, expertise, and resources

• Activities to stimulate innovation and growth

• SME support got new-to-firm innovation

• Adopt productivity-enhancing, energy efficient and low carbon technologies and techniques

If you are interested in submitting an application to become a delivery partner, please go to YORtender (https://yortender.eu-supply.com/). The procurement documents have been amended and republished to include the new categories.

All further competitions under the Employment and Skills Dynamic Purchasing System will take place on via https://yortender.eu-supply.com/ as of 1 January 2023, therefore existing delivery partners will need to ensure they are registered on the new categories portal in order to receive invitations to further competitions under these categories.

Contract Award Notices are published every quarter in accordance with the Public Contracts Regulations 2015. These Contract Award Notices detail the awarded delivery partners for each call-off under the DPS.

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The Council has identified the need for two new categories which was not foreseen at the commencement of the Dynamic Purchasing System, due to Brexit and subsequent emergence of new UK funding streams. All other terms of the DPS remain the same.
