Explanation:

(Regulation 84 (1))

Negotiated procedure without prior publication of a contract notice (Regulation 32(2)(b)(iii)). The subject contract is a public service contract which can only be carried out by the Supplier due to the protection of exclusive rights, namely copyright in a video archive owned and licenced by the Supplier. No reasonable alternative or substitute exists because the University had a requirement for specialist resources of sufficient depth, breadth and quality to meet the requirements of a specialist postgraduate Master's programme in film and television production. A series of searches for appropriate providers/resources was carried out, but none of the alternative providers/resources identified had sufficient or appropriate materials to meet the requirements of asynchronous learning on the proposed specialist degree programme.
