Description

The Association of North East Councils Ltd trading as the North East Procurement Organisation (NEPO) is seeking to establish a multi-contractor, multi-lot Framework for the provision of a highways surfacing works framework. This Framework offers Contracting Authorities access to Suppliers providing a diverse range Highway Surfacing Works.

The works covered in the Framework have been split in to 18 lots:

The value of each lot is determined by dividing the framework value by the number of lots. While individual lots may exceed their calculated value, the total must not surpass the overall framework value.

NEPO intends that the Framework period is up to 8 years with readvertisement before year 3 and year 5, prior to expiry of the Framework term. As such, suppliers which have not been appointed to this Framework will have the opportunity to be appointed to the subsequent framework.

During the period of the Framework, NEPO may issue modifications to the lot structure with the introduction of new lots for highway surfacing works which cannot be foreseen at this time for example innovative techniques/products.

Further information about fees

NEPO operates a contract rebate arrangement whereby Suppliers are asked to repay NEPO a set percentage of each invoice in respect of orders placed by NEPO or any Contracting Authority accessing the Framework. The maximum rebate taken by NEPO against the value of awarded contracts will not exceed 0.5%.

Framework operation description

The successful suppliers will be appointed to the Framework (NEPO210 Highways Surfacing Works) with NEPO. This Framework will be made accessible to Contracting Authorities via Call-Off Contracts. NEPO will establish overarching terms and conditions that define the core principles of the Framework.

When a Contracting Authority with an active Call-Off identifies a need that can be met under the Framework, they will enter into a project-specific Call-Off Contract with the awarded supplier. These project-specific terms and conditions will be developed in agreement between the Contracting Authority and the supplier.

Pricing will be determined through the tender process and evaluated against predefined award criteria and associated weightings. All tenders will be assessed accordingly, and suppliers will be ranked based on their final evaluation scores.

Pricing submitted as part of the establishment of this Framework will apply to requirements within the North East region only.

For use outside the North East region, participating authorities must conduct a further competition under the terms of the Framework Agreement.

NEPO will conduct an annual pricing review using the BCIS index. Additionally, NEPO may seek pricing from all Framework Suppliers for new items proposed for inclusion in the Framework.

Supplier rankings may be re-evaluated and adjusted during the review points before year 3 and 5 of the Framework term. This re-ranking will consider updated pricing for the upcoming 12 months in conjunction with the original quality scores awarded during the tender process.

Contracting Authorities may establish Call-Off Contracts through either Direct Award (based on ranking) or Further Competition.

In cases of Direct Award, pricing will be based on the tendered rates within the Framework. While suppliers may offer lower rates, they must not exceed the maximum rates set out in the Framework.

All suppliers appointed to a particular lot to the Framework may be invited to participate in Further Competitions. The evaluation criteria for any Further Competition will be specified by the Contracting Authority and included in the competition documentation. Suppliers will be required to submit pricing based on the specific project requirements. While suppliers must not exceed the maximum rates outlined in the Framework, they are encouraged to submit competitive offers below these thresholds where appropriate.

NEPO intends to make the resulting agreement available for use by all Contracting Authorities throughout all administrative regions of the UK including but not limited to Government Departments and their Agencies, Non-Departmental Public Bodies, Central Government, NHS Bodies, Local Authorities, Emergency Services, Coastguard Emergency Services, Educational Establishments, Registered Social Landlords and Registered Charities.
