The Service will commence on 1.4.2017 and will be put in place for 4 (four) years; therefore the expiry date will
be 31.3.2021. The Council may extend the Contract by up to 24 months, making the final possible expiry date

seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
Modifiy the Contract so that it now requires the Service Provider to extend services to persons suffering with Long Covid for the remainder of the term, in consideration for an additional £104,771.50.
seven.2.2) Reasons for modification
Need for additional works, services or supplies by the original contractor/concessionaire.
Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:
The modification is permitted under Regulation 72(1)(b) of the Public Contracts Regulations 2015. It remains necessary that Nova continue to manage the necessary increase in service referrals for the reasons set out in the Relevant Circumstances (above), albeit these additional services were not included in the initial procurement.
A change in contractor cannot be made for economic and technical reasons. As set out in the Relevant Circumstances (above), it is necessary to increase referrals for Long Covid. The Pandemic occurred after the initial procurement, at which time the Council's requirements in respect of the Live Well Wakefield Service managing social prescribing for an increased category of service users was unknown. Nova is responsible for the provision of the Live Well Wakefield Service until 31st March 2023. During the remainder of the contract term it is fundamental that the Live Well Wakefield Service and the social prescribing pathways for Long Covid are effectively integrated and managed together to ensure service delivery is effective (with access to established infrastructure, reporting mechanisms and experience). It is not economically or technically feasible for another contractor to be involved in providing only this element of the LWW service and notwithstanding which, for reasons as explained above, competition is very likely to be absent.
Even where those difficulties could be overcome (which, as explained above, the Council considers not to be possible), this would inevitably result in significant inconvenience and substantial duplication of costs. In particular, the need to monitor the activity of two contractors and the interface between the two during the remainder of the contract term would impose cost and resource demands on the Council, which the Council is not able to meet. Furthermore, the introduction of a new contractor would delay and obstruct the integrated pathway referral, impacting on the social prescribing offer in the Wakefield district.
