seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The modification notice is published to uplift the contract value by £215,900.00 excluding VAT.

The Department will rely on Regulation 72(1)(b), where additional services by the original contractor have become necessary and were not included in the initial procurement, but where a change of contractor (i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing services procured under the initial procurement, and (ii) would cause significant inconvenience or substantial duplication of costs for the contracting authority; and (iii) any increase in price must not exceed 50% of the value of the original contract.

Reliance on regulation 72(1)(b) requires the Authority to publish a “modification notice” on FTS (UK e-tendering services) describing the modification made and the exception relied on.

The modification fall below the 50% limit imposed by Regulation 72(1)(b).

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Ongoing programmes of work that require consistency of service. Authority will be re tendering by current contract end date and not taking up options to extend this contract beyond it's original end date of March 2024.
