The transfer of commissioning responsibility for public health nursing services for 0-5 year olds, from NHS England to Nottinghamshire County Council (the Council) in October 2015, brought together commissioning responsibility for all public health nursing services for 0-19 year olds within Nottinghamshire and offered opportunities for integration.
Nottinghamshire County Council is now seeking to procure an integrated Healthy Child and Public Health Nursing programme for 0-19 year olds, to be operational from 1.4.2017.
The primary aim of the service will be to offer an integrated public health nursing service in line with the Healthy Child Programme to all families in Nottinghamshire. The Healthy Child Programme is the Department of Health's early intervention and prevention public health programme. It offers every family a programme of developmental reviews, health needs assessments and information and guidance to support parenting and promote healthy choices.
The integrated service will deliver:
- Healthy Child Programme 0-5 years and 5-19 years (public health nursing);
- Family Nurse Partnership Programme (FNP);
- National Child Measurement Programme;
- Breastfeeding support;
- Promotion of public health and healthy lifestyle choices and brief intervention, making every contact count.

seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
The modification is to advise of the extension and variation of the Council's contract with Nottinghamshire Healthcare NHS Foundation Trust (NHFT) for delivery of the Nottinghamshire Healthy Families Programme (HFP) .
Variation 9 - To extend the contract from the current expiry date (30th September 2024) to 30th September 2025 and to amend the Agreement and Service Specification in matters relating to performance management and quality assurance mechanisms, and appropriate changes to the contractual arrangements to facilitate the management of any contractual issues.
seven.2.2) Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:
This is an urgent modification notice under the NHS Provider Selection Regime (PSR) regulations. 14(2)a, b and c:
(a)an award or modification must be made urgently,
(b)the reason for the urgency was not foreseeable by and not attributable to the relevant authority, and
(c)delaying the award of the contract or modification to satisfy the requirements of regulations 6 to 13 would be likely to pose a risk to patient or public safety.
The modification must be made urgently due to no contract extension periods available on the current contract and therefore outside of the scope of the regulations and is as a result of matters that have arisen, which were unforeseeable and outside the Council's control in response to the 'rapid review' of mental healthcare provision at NHFT by the Care Quality Commission (CQC ). The extension will give the Council time to take into account the Care Quality Commission (and any other regulatory bodies) actions and recommendations and to consider the best way of delivering the Nottinghamshire HFP in the future.
