Following a market engagement event in August 2023 (see https://www.find-tender.service.gov.uk/Notice/018457-2023), National Highways will be seeking a new partner to deliver transformation and change services in our business for up to 5 years from late-2024 with an estimated value of £75 million. We intend to use the Restricted Procedure and Selection Questionnaires are expected to be issued in mid-December, subject to the completion of project governance.

two.2.4) Description of the procurement

National Highways’ approach for dealing with conflicts of interests on this procurement will be set out in the procurement documents and will reflect public sector best practice. Part of this approach will be to require bidders to sign "Managing Conflicts Agreement" at the Selection Questionnaire stage. This Agreement shall require potential bidders to proactively identify and agree with the Authority any individuals within their organisation who are actually or potentially conflicted or considered to have had access to information which gives them an unfair advantage which cannot be mitigated or neutralised by any other reasonable measures. If any such individuals are identified the bidders shall be required to construct an information barrier or "ethical wall" internally to remove those individuals from their bid team and protect the integrity of the process.

A draft copy of the "Managing Conflicts Agreement" has been provided for reference only and is available as an attachment on the associated Contracts Finder notice at https://www.contractsfinder.service.gov.uk/Notice/12a360ff-e611-4c3f-b04f-9c0564c121f6. A final version of the Agreement will be published with the Selection Questionnaire.
