Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

Due to the ongoing complexity of the implementation of the McCloud Remedy Legislation, it is the considered view of the Contracting Authority that there is no alternative option other than to continue to contract with the incumbent supplier at this time. Grounds for justification have been summarised below:

- Complexity and repercussive nature of any change to the current supply chain during implementation of a legislative requirement.

- Continuity of skill and experience to deliver and maintain the current Pension Software.

- Change management of solutions and data transfer/migration at this current time would be both contentious and repercussive to both the Scheme Managers and the Scheme Members.

All efforts have been made to ensure value for money and continuity of service under the direct award approach and any extension or new contract will be subject to the normal contract management and performance processes.

It should be noted that the incumbent software supplier is not party to any accessible national framework. As a result, the Contracting Authority can only proceed on the basis of a Single Tender Action (STA) on the grounds of skill/experience, cost of change and legislative obligation.
