This programme is for continued Contract Logistics Support and Post Design Services (PDS) tasking to one hundred and twenty-two (122) Remote Controlled Vehicles (RCVs) which are an essential component of meeting the Defence Explosive Ordnance Disposal and Search requirement for EOD operations in the Contingent and Military Aid to Civil Authorities (MACA) roles.

During 2017, STARTER was procured and initially served as a fleet of 56 platforms for deployment on Contingent Operations . Later during 2019 an additional 66 platforms were procured for use on MACA .

As STARTER is for Contingent Operations it is imperative that as many repairs as possible can be conducted at Level 1 and Level 2 . L3 Harris Technologies’ RCV has been specifically designed for ease of maintenance. This includes a modular design that enables easy break-down for repair and maintenance. A total of 66% of all major assemblies and components can be repaired / installed at maintenance Levels 1 or 2.

four.1) Description

four.1.1) Type of procedure

Explanation:

In accordance with regulation 4 of the Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.

It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the DSPCR 2011 for technical reasons. There are technical impracticability and interoperability issues which would prevent another supplier from providing the required services.

The Authority are procuring directly with L3Harris Technologies Inc following confirmation the company is the Original Equipment Manufacturer. L3Harris Technologies Inc have managed the current STARTER contract for the last 7-years which is when it was brought into service.

The STARTER System has a modular design that which, only with access to the equipment manuals and technical publications, enables easy break-down for repair and maintenance. Any manuals, technical publications, drawings or expertise knowledge which are owned by L3Harris Technologies Inc have not and will not be released to a third Party supplier. Without the release, access to of the manuals or technical publications it would not be possible for another Supplier to fulfil the requirement or to perform any modifications or equipment repairs throughout the duration of the contractual agreement.
