four.1) Description

four.1.1) Type of procedure

Negotiated without a prior call for competition

Explanation:

A direct award has been made to Pinsent Masons under Regulation 32 as competition is absent on the technical grounds that Pinsent Masons have significantly more previous knowledge of the project.

In 2015, Leeds City Council conducted a further competition under the CCS Legal Framework, specifically under Lot 8 Complex and Major Projects. Following the tender process, Pinsent Masons were awarded a 2 year contract. In 2017, a further contract was awarded to Pinsent Masons, for 48 months including extension options. This contract is due to expire on 31 December 2021.

Although the Council is dealing with some matters in-house, there is continued legal advice required for the East Leeds Extension and East Leeds Orbital Road projects. Due to the costs involved in bringing a new provider on board and up to speed with the project, Pinsent Mason's previous involvement which commenced in 2015 and the technical knowledge they have gained regarding the project as a result, it is considered that Pinsent Masons are best placed to be reappointed to continue providing the required legal expertise on this project. As such, the Council considers that there is no other reasonable alternative and is therefore awarding a two year contract direct to Pinsent Masons. This contract will commence in January 2022.
