four.1) Description

four.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

Explanation:

The Vehicle Support Team, part of the Ministry of Defence, intends to place a contract with Petards for the provision of 292 Drivers Audible Warning Boxes (DAWB) to operate on the following platforms: Challenger 2 Main Battle Tank (CR2), CR2 Driver Training Tank (DTT) and Challenger 2 Armoured Repair and Recovery Vehicle (CRARRV); at an estimated value of £669,000 inclusive of VAT.

DAWB is a system designed to alert the driver of faults or issues which have been identified by the Vehicle Integrated Control System (VICS) for the CR2, DTT and CRARRV platforms. DAWB acts as a technical interface, reading signals from the VICS (which are then shown on the Driver’s Instrument Panel (DIP)) and converting them into audible alerts so the driver can hear should a fault occur.

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.

It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 for technical reasons. Only Petards, as the owner of the DIP and interface drawings with VICS has access to the technical information, and has the technical expertise, knowledge and know-how necessary to supply a DAWB system that will successfully interface with the existing CR2, DTT and CRARRV platform architecture.
