This service is required to facilitate the maintenance of the Pride Park Water Treatment plant to meet the monitoring requirements of the Environment Agency Discharge Permit and enable the Water Treatment Unit to control and manage and avoid the discharge of polluted water from the brownfield site of Pride Park into the River Derwent.

two.2.4) Description of the procurement

The supply of services in respect of the operation and maintenance of the groundwater treatment plant and associated environmental monitoring at Pride Park, Derby. This service is required to facilitate the maintenance of the Pride Park Water Treatment plant to meet the monitoring requirements of the Environment Agency Discharge Permit and enable the Water Treatment Unit to control and manage and avoid the discharge of polluted water from the brownfield site of Pride Park into the River Derwent.

This procurement is required to meet the Council's obligations as a duty holder under the following legislation and obligations. The Environmental Protection Act (1990) which requires the owner of any land where any contaminated substances are known to be, not permit those substances to be in, or on or under any other land to which they appear to have escaped. The Environmental Permitting (England and Wales) Regulations 2010: under which it is an offense to knowingly discharge poisonous, noxious or polluting matter or solid waste matter into inland freshwater. The successful management of the water treatment plant and waste repositories are an environmental requirement imposed by the Environment Agency.

The Contract also protects businesses on Pride Park who all pay a service charge to fund the reclamation infrastructure on Pride Park. In addition to running the water treatment plant the contract also includes the management of monitoring wells around the two waste repositories on Pride Park containing a combined total of 95,000m³ of contaminated gas works waste.

Service Provider already in use at Council for recent years. The Council has published this VEAT notice and intends to award a contract following a 10 day standstill period for this notice.

Description of options

The contract start date will be length will be 2 years with the option to extend for 2 x 1 year periods. If all extensions are utilised, the total contract length with be 4 years.

A change of provider at the current time would have a major impact on work activity, costs, and compliance with aforementioned requirements. It is proposed to directly award a contract without prior publication of a call for competition.
