four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • Extreme urgency brought about by events unforeseeable for the contracting authority

Explanation:

'This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.'

Regulation 14 has been applied due to ongoing delays in planned delivery and procurement to expand the existing service contract. Currently the provider has continued to provide the activity coordinator/member of staff in service with the expectation of contract expansion to include existing services. However due to delays there is a financial risk to the provider and the trust, should the provider remove the member of staff from service this would impact on patient care and trust services creating greater pressure on rehab services.

The contract term is 12 month

Decision makers include Jemma Amer, Contract Manager, John Chapman Head of Accounting and Governance and Liz Romaniak Director of Finance, no conflicts on interest.
