Explanation:
Since we have left the EU the EU Regs do not apply. The grounds for this extension are as follows: This 3 year extension to the original contract is being awarded under the negotiated procedure without prior publication of a contract notice in accordance with Regulation 16 of the DSPCR 2011. The works/goods/services can be provided only by Helmet Integrated Systems on Technical Grounds. The Air Commodities team intends to award a 3 year extension to the original contract awarded in December 2016. Helmet integrated Systems have the technical know-how, access to the required safety requirements and technical documentation to fulfil the requirement to the required safety levels. As the supplier is the OEM for the equipment they have access to data/documents that are proprietary, necessary for the fulfilment of the requirement which no other contractor has access to therefore no other contractor could fulfil this requirement.
