The National Infrastructure Strategy committed government to producing an overarching policy paper on economic regulation. A key part of the policy paper will concern the government conducting a review of economic regulator's duties in 2022. To inform this review, we need to commission an analytical study into regulators' duties in telecoms, energy and water. The study will assess how well regulators have been meeting their existing duties, the effectiveness of existing duties, what impact has resulted from new duties being introduced, and recommend areas the government review should focus on.

The ITT will be issued in early January 2022.

By March 31, Government requires a report setting out the following for telecoms (ofcom), energy (ofgem) and water (ofwat) regulators:
A. A map of regulators’ duties
B. How regulators have been meeting their duties in practice? This includes considering how well regulators ensure:
- private sector investment
- the resilience of infrastructure systems
- meeting government’s legislated greenhouse gas emissions targets
- protecting consumers and improving their outcomes
- making trade offs between different duties
- Collaboration with other regulators to promote efficient outcomes for consumers.
C. How well duties can be considered to be functioning as a result of the above?
D. The impact of introducing of new duties over time on decision making?
E. Recommendations for areas that a future government review could consider?
