North Yorkshire Council shall in accordance with the Public Contracts (Amendment) Regulations 2015, incorporate a minimum 10 day standstill period commencing at the point that information on the intention to award the contract is sent to tenderers.

The Council shall, as soon as possible after the decision has been made, inform the tenderers and candidates of its decision, and shall do so by notice in writing by the most rapid means of communication practicable.

Should additional information be required, please contact the person cited in paragraph I.1) of this form. If an appeal regarding the award of a contract has not been successfully resolved, Public Contracts Regulations 2015 (SI 2015 No 6) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).

Any such action must be started within 30 days beginning with the date when the aggrieved party first knew or ought to have known that grounds for starting the proceedings had arisen. Where a contract has not been entered into the Court may order the setting aside of the award decision or order the authority to amend any document and may award damages. Following the 10 day standstill period, if no further debriefing has been requested, the Court may only award damages once the contract has been entered into.

The Authority wishes to award an Approved Provider List for the provision of Training and Learning, Apprenticeships and Exam Centres.

Lot 1 - Provision of Training and Learning for NYC employees and adult residents over the age of 19, across York and North Yorkshire as a result of, but not limited to, Adult Education Budget (AEB) funding and grant funding such as DfE Skills Bootcamps, Multiply and UK Shared Prosperity Fund programmes. This lot may also be utilised for administration services required as a result of the above.

Lot 2 - Provision of Apprenticeships for NYC employees.

Lot 3 - Provision of Exam Centres for young people in the North Yorkshire Region.

York and North Yorkshire Combined Authority should have been listed as a permissible user of this Approved Provider List within the Contract Notice and procurement documentation. Due to a drafting error, this was omitted.

Details of only one awarded contract has been provided in Section VII. Details of all 111 awarded contracts can be accessed on the original Contract Award Notice.

Need for additional works, services or supplies by the original contractor/concessionaire.

Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

York and North Yorkshire Combined Authority (YNYCA) should have been listed as a permissible user of this Approved Provider List within the Contract Notice and procurement documentation. Due to a drafting error, this was omitted.

YNYCA spend via the Approved Provider List was included in the total value as set out in the original Contract Notice.

The proposed variation does not change the economic balance of the contract as the total value of the procurement (excluding VAT) will remain as set out in the original Contract Notice.

Providers will still have the ability to apply to the Approved Provider List throughout the term of the contract.
