Explanation:

The Air Defence & Electronics Warfare Delivery Team, part of the Ministry of Defence, intends to award a contract to Textron Systems Electronic Systems UK Limited, of 23 Bedford Row London, WC1R 4EB, United Kingdom, to supply a Man-Portable Aircraft Survivability Trainer (MAST), which will be manufactured by Textron Systems Corporation (Electronic Systems), of 124 Industry Lane, Hunt Valley, MD, 21030, USA.

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this contract falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.

It is considered that this contract can be awarded without prior publication of a contract notice in the UK e-notification service in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons; and in accordance with regulation 16(1)(b)(i) of the Defence and Security Public Contracts Regulations 2011 for additional purchase of goods as a partial replacement for existing goods where a change of supplier would oblige the procurer to acquire goods having different technical characteristics, resulting in disproportionate technical difficulties in operation and maintenance of the existing goods.

This is because there is strict technical impracticality for a supplier other than the chosen supplier to achieve the required goals, and specific interoperability and safety requirements that must be fulfilled to ensure the functioning of the armed forces. Operating two potentially different systems would introduce an additional training requirement and potential safety risk where operator applied safety systems and measures could be inadvertently mixed up. Also, the complexity of MAST and the associated requirements for interoperability of a new MAST and the existing equipment such as the interchangeability of the MAST units themselves, and of parts, programmable aspects and batteries and the tripod, and the need for standardisation of equipment in the defence arena for the reasons set out, requires supply by the same manufacturer.
