Intermediate Minor Oral Surgery (IMOS) which is aimed at those patients who require Level 2 care - that is 'procedural and/or patient complexity requiring a clinician with enhanced skills and experience who must be accredited to perform Tier 2 Oral Surgery procedures.

Direct Award of a PDS Contract for IMOS Services in Shrewsbury with effect from 15th November 2024 until 14th November 2031 with the potential to extend until 14th November 2034.

Contract value - 7 years = £1,462,821.64, plus up to a further 3 years = £626,923.56.

Total contract value over the full 10-year term = £2,089,745.20.

These values are not inclusive of the 2024/25 DDRB uplift which are yet to be published.

The Service to which this relates fall within Schedule 3 of the Public Contracts Regulations 2015 (the" Regulations") as amended by The Public Procurement (Amendment etc) (EU Exit) Regulations 2020, (the" Regulations") and the Procurement, Patient Choice and Competition Regulations (2) 2013.

As such, the Contracting Authority does not intend to hold itself bound by any of the Regulations, or those applicable to

Schedule 3 Service.


Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

  • No tenders or no suitable tenders/requests to participate in response to open procedure

Explanation:

The ICB have ran two separate IMOS procurements across Shropshire and Staffordshire in 2022 where there were 5 lots (Stoke, Stafford, Burton, Telford and Shrewsbury). During the first procurement the ICB failed to secure providers for Burton and Shrewsbury. The second procurement sought to secure providers for Burton and Shrewsbury but were only able to secure a provider for Burton.

Since the first procurement, the Telford IMOS provider has been providing a wider IMOS service to cover patients from the Shrewsbury from their premises in Telford.

Following the failure of the 2 procurements for Shrewsbury, the ICB ran a targeted expression of interest exercise (EoI) for Shrewsbury aimed at all successful Shropshire and Staffordshire IMOS bidders and those that didn't secure a contract but whose total procurement score was above the minimum qualifying threshold.

Following the EoI process, one provider came forward, this being the provider for the Stoke and Stafford IMOS lots.

The ICB has therefore concluded that Regulation 32 of The Public Contracts Regulations 2015 is applicable to this situation and wish to Direct Award the Contract to Visiting Specialist Services Limited.

Use of the negotiated procedure without prior publication

32.-(1) In the specific cases and circumstances laid down in this regulation, contracting authorities may award public contracts by a negotiated procedure without prior publication.

(2) The negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases:-

(a)where no tenders, no suitable tenders, no requests to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not substantially altered and that a report is sent to the Commission where it so requests;
