The current agreement for the provision of South East Wales Independent Mental Capacity Advocacy expires on 31st March 2024. It is the intention to proceed with an agreement for an Independent Mental Capacity Advocacy Service on behalf of all Health Boards in Wales from 1st April 2024.

This notice is to inform the market of the future contract plans and that NWSSP Procurement Services will be holding a pre-procurement event on Wednesday 30th November 2022. The format will be a short presentation in the morning of the 30th of November via Microsoft Teams followed by a short question and answer session.

This will be followed by the opportunity for individual 20 minute 1:1 sessions in the afternoon with Health Board representatives and representatives from NWSSP Procurement Services. .

If the service decides to undertake a procurement exercise this will be advertised as appropriate at the relevant time. This notice is also an opportunity for any potential providers to submit requests for tender documentation in Welsh. Any requests for documentation to be provided through the medium of the Welsh language must be submitted via email to david.makani@wales.nhs.uk by Wednesday 9th November 2022.

This is not a call for competition but an opportunity for providers within this market to meet with NWSSP Procurement Services and Health Board representatives. If the service decides to undertake a procurement exercise this will be advertised as appropriate at the relevant time.

This Pre-Market engagement stage is an opportunity for NWSSP Procurement Services and Health Board representatives to notify the market of the intention to procure on an All-Wales basis and the need to factor in Liberty Protection Safeguards. This event will allow NWSSP Procurement Services & Health Boards to gain an understanding of LPS from a market perspective. This engagement event will be a virtual event via Microsoft Teams held on Wednesday 30th November 2022, exact timings to be confirmed. Following a short presentation, current providers and potential bidders will have an opportunity to participate in a live question and answer session. The afternoon session will then be an opportunity for those providers and bidders to attend a 20-minute 1:1 meeting with NWSSP Procurement Services and Health Board representatives again via Microsoft Teams. Individual time slots will be allocated on a first come first served basis.

NWSSP Procurement Services accepts no liability for any costs incurred by current providers/potential bidders as a result of attending the engagement event.

It is intended that all information provided and gathered will be publicly available in the form of a 'frequently asked questions' document or in any format determined by NWSSP Procurement Services which shall be available to any bidders to ensure transparency and fairness in any procurement process going forward. It should be noted that any figures provided are indicative of historical use only and they do not take into account LPS. The figures should not be construed to indicate any guarantee or levels of spend.

The Contracting Authority anticipates that any procurement exercise which may be taken forward in the future shall be subject to the Light Touch Regime in accordance with Schedule 3 of the Public Contract Regulations 2015 as amended.
