Explanation:
It is considered that this contract can be placed using the Negotiated Procedure without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because BAE Systems (Operations) Ltd and their subsidiaries are the only companies to have access to the Hawk TMk1 aircraft data packs and other technical information in order to supply the Authority with an accurate replica of the Hawk T Mk1 aircraft for the use of synthetic training for all RAF user groups. The UK RAF require use of high-fidelity synthetic training devices to ensure suitably trained staff for safe, effective and efficient operational delivery.
Therefore, for reasons of safety to life and data access restrictions, the Authority intend to enter into contractual negotiations for the delivery of a UK Hawk T1 Aircrew Ground and Synthetic Training Service for all Hawk User Groups.
