DMSL is managing a tender on behalf of the mobile network operators (EE, Telefonica, Three and Vodafone, collectively the "Contracting Organisations") to appoint suppliers who are able to provide all of the ADB services for mobile telecoms base station sites. Each of the Contracting Organisations will be a signatory to the ADB framework.
Neither DMSL nor the Contracting Organisations are contracting authorities. This tender is being conducted voluntarily under the Public Contracts Regulations 2015 ("PCR") as call-offs awarded under the framework will be contracts subsidised by the Department for Culture, Media and Sport within the meaning of Regulation 13 of the PCR.
The ADB framework may be used by each of the Contracting Organisations and each of their Build companies: Cornerstone Telecommunications Infrastructure Limited (CTIL) and Mobile Broadband Network Limited (MBNL).

DMSL is managing a tender, on behalf of the Contracting Organisations, to appoint suppliers on a ADB framework, to provide all of the services of Acquisition, Design and Build services for telecoms mast base station sites. The ADB services are expected to be provided, through the call-off contracts, in different combinations or as a single solution.
These sites are part of the Shared Rural Network (SRN) which consists of circa 300 new telecoms mast base station sites in rural and remote locations across the UK. The sites are planned to be delivered either through this ADB framework or through a Managed Services framework (the procurement for which is being run in parallel), or a combination of both frameworks.
These sites will enable Contracting Organisations, as part of the SRN programme, to fulfil their Ofcom Spectrum licence obligations by giving greater mobile network coverage in the UK.
Each of the Contracting Organisations will be a signatory to the ADB framework.
The scope of ADB services includes:-
Acquisition:-
The Contracting Organisations are seeking suppliers who are suitably capable and experienced providers of Acquisition services relating to the deployment of telecom mast base station sites. Expected activities would include but are not limited to; working with the Contracting Organisations to undertake and find a suitable site through site searches, identifying the relevant site providers to grant the necessary rights to occupy and access the site, negotiating with such site providers to secure the rights to occupy and access the site (including supporting on any Electronic Communications Code (ECC) proceedings), and undertaking the necessary steps to obtain appropriate planning permissions. It is expected that the supplier will provide any project management to carry out this role and liaise with other project participants in achieving a successful delivery of a site location.
Design:-
The Contracting Organisations are seeking suppliers who are suitably capable and experienced providers of construction design services to facilitate in the delivery and deployment of telecoms mast base station sites. The supplier will also provide the construction designs for the telecoms mast base station site, covering aspects such as general arrangement drawings, detailed design for construction and as built drawings and compliance with all the statutory obligations under the CDM 2015 regulations of a principal designer. It is expected that the supplier will provide any project management to carry out this role and liaise with other project participants in achieving a successful delivery of a site location.
Build:-
The Contracting Organisations are seeking suppliers who are suitably capable and experienced providers of construction services to facilitate in the delivery and deployment of telecoms mast base station sites. The supplier would be expected to undertake all the elements that are required to build the infrastructure as per the detailed design document. The supplier will also be required to comply with all the statutory obligations under the CDM 2015 regulations of a principal contractor.
For clarity, supply of the passive physical infrastructure, such as towers and cabinets will be outside the scope of this procurement and will be supplied by or through the Contracting Organisations. Radio access equipment is also outside the scope of this procurement and will be supplied through the Contracting Organisations.
It is expected that the supplier will provide any project management to carry out this role and liaise with other project participants in achieving a successful delivery of a site location.

DMSL considers that this ADB framework may be suitable for economic operators that are small or medium enterprises. Any selection of suppliers will be based solely on the criteria set out for this ADB procurement.
The Contracting Organisations wish to award contracts to suppliers who will take sole responsibility for delivery of all services contracted for under this ADB framework. For clarity, suppliers may use sub-contractors to deliver the services.
Parent company guarantees may be required at DMSL and the Contracting Organisations' discretion. Further details will be provided in the procurement documents.
Neither DMSL nor the Contracting Organisations will accept multiple applications for this procurement from the same entity / economic operator.
The term of the ADB framework is 65 months with an option to extend once for a further 24 months. A period longer than 48 months has been chosen for the framework to align to the delivery obligations set out in each Contracting Organisation's Spectrum licence.
DMSL and the Contracting Organisations expressly reserve the right not to award any contract as a result of the procurement process commenced by publication of the Contract Notice.
In no circumstances will DMSL or the Contracting Organisations be liable for any costs, expenses, fees or charges (including third party costs) incurred by those expressing interest in and/or participating in dialogue and/or tendering for this opportunity.
No contract (whether implied or otherwise) for the ADB framework or call-off contract for ADB services shall exist between any applicant and the Contracting Organisations until such time as such ADB framework or call off is executed with a supplier.
No minimum volume or purchase value is guaranteed for any supplier.
The volume of work awarded to suppliers may be limited to reduce the risk to delivery, retain project integrity and ensure that resources are available to deliver.
DMSL and the Contracting Organisations reserve the right to make any changes to the procurement as it may require at any time with no liability on its part (including to change, suspend, stop or terminate the process and not award a contract and/or to reject any or all bids at any time).
