The Environment Agency have established a Framework Agreement that will be utilised for the following requirements: -
-Civil Engineering projects;
-Mechanical Electrical Instrumentation Control and Automation projects;
-Vegetation Management programmes;
-Landscape and Habitat Creation Implementation and Establishment Aftercare; and
-Asset Operation and Incident Response activities

The framework has 3 Lots
Lot 1 - Civil Engineering: Maintain and Construct
Lot 2 - MEICA Refurbishment and Maintenance
Lot 3 - Vegetation Management. Landscape and Habitat Creation

The duration of the Framework is three years (36 months) with one optional one-year (12 month) extension (totalling fours years or 48 months).

The total estimated value of the Framework based on a four year (48 month) duration is between £500,000,000.00 - £600,000,000.00.

seven.2) Information about modifications

seven.2.1) Description of the modifications

Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The Environment Agency are changing the description of Lot 1 Civil Engineering in the Framework Schedules and Deed to remove the reference to ‘Contracts <£1m’ and replace this with the following wording ‘This Lot is for awards of work up to £1m. However, for contracting and delivery efficiencies the Client may bundle together separate works that would have been delivered through multiple discrete contracts up to £1m into one contract with a value of over £1m.’

seven.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee.

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The Environment Agency are modifying the description of Lot 1 to remove the erroneous restriction on contracts above £1m and to correct the application of the £1m limit to apply to discrete awards of work.
The ambition is to create bundles of works to drive more efficient delivery and provide greater value for money. This was communicated to the market during the procurement of the framework through the Bidder Pack and through an ITT clarification.
