four.1) Description

four.1.1) Type of procedure

Explanation:

1. The Air Platform Systems Platform Protection Delivery Team, part of the UK Ministry of Defence (MOD), intends to extend an existing contract entered into with Petards Joyce-Loebl (PJL) on 1st January 2022 for the through-life support of ALE-47 and M-147 Counter Measure Dispensing Systems (CMDS) that are fitted to Chinook (all marks), C-130, Puma and Merlin Mk.2 and Mk.4 aircraft. The original, estimated value (net of VAT) of the contract was £4.7M and the Contract’s original term was 01/01/2017 – 31/12/2021. The estimated value (net of VAT) of the extension is £295,898 and the scheduled term of the extension is 6 months.

It is considered that this extension can be entered into using the negotiated procedure without prior publication of a contract notice pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 (SI 1848) on the basis that PJL alone can carry out the services under it for reasons connected with the protection of exclusive rights that subsist in the software and equipment required to deliver those services.
