Explanation:
The Secretary of State for Defence intends to amend a current supply contract with CGE Risk Management Solutions B.V. for the purchase of additional user licences for use by MOD personnel to create “bowtie” diagrams which visualise complex safety information and transfer that information from Air DT safety staff to Aviation Duty Holders to support engineering processes which relate to equipment safety as part of the Authority’s support of and maintenance to its air platforms.
In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 32(b)(ii) of the PCR 2015 because competition is absent for technical reasons. The Authority needs to purchase these additional licences from the original contractor and cannot consider a change of contractor for technical reasons as all the
Air DT staff need to use the same software to create uniform, similar bowtie diagrams across the Authority’s air platforms and in addition, to do anything different would cause significant or substantial duplication of cost.
