1) Justification for the choice of the negotiated procedure without prior publication of a contract notice
The works/goods/services can be provided only by a particular tenderer for reasons that are:
technical
A requirement for supply of Land Rover spares was subject to a competitive tender exercise by Babcock Land Defence Limited (formerly Babcock DSG Ltd) in 2019 under the Service Provision and Transformation Contract (SPTC) in place with UK MoD. However, VST identified discrepancies within its existing Land Rover Bill of Materials - raising concerns with the standard of components being supplied which could potentially impact the safe and reliable operation of the vehicle fleet - and the competition was cancelled. UK MoD has now reviewed the Bill of Materials and cleansed its data systems through removal of non-conforming parts, enabling Babcock Land Defence Limited to commence a new competitive tender exercise for the supply of Land Rover spares on behalf of UK MoD. This is now underway and expected to conclude in late 2021.
Whilst therefore acknowledging that other Suppliers exist in the market, the associated delays have resulted in a prolonged capability gap that prevents UK MoD from safely maintaining and supporting its operational Land Rover vehicle fleet - hence there is a need for a further interim contract for the supply of Land Rover spares. Hobson Industries Ltd have a proven ability to supply such spares to the required specification, reliability and safety standards - ensuring the vehicle configuration aligns with the original approved systems that underpin the endorsed platform safety case - with timely access to Jaguar Land Rover, the Original Equipment Manufacturer (OEM).
