Explanation:

2BM Ltd owns the IPR of the software. DVLA currently own perpetual Sensorium licences which can only be administered and supported by the vendor. 2BM Ltd are the only supplier that can configure the system and are the only supplier qualified to configure the software.

2BM Ltd only contract directly with customers and are not on any government frameworks.

For this requirement the justification is:

32 (2) (b) where the works, supplies or services can be supplied only by a particular economic operator for any of the following reasons: —

(ii) competition is absent for technical reasons,

(iii) the protection of exclusive rights, including intellectual property rights
