Explanation:

The Secretary of State for Defence intends to enter into a service contract with Marshall Aerospace and Defence (Marshalls) for the procurement of for associated support to maintain TMDP (Tactical Map Dissemination Point) and FMDP (Forward Map Dissemination Point) Containers. Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful for technical reasons:

a. Marshalls are the OEM for these specialised containers. As the design authority for these, they have the technical knowledge, know-how and tools to carry out the requirement to the expected standards.

b. To use any other supplier will create a risk that the expected standards will not be met as they will need time to become accustomed to the specialised nature of the containers (which are not standardised), which may lead to elements of the containers being reverse engineered.
