  • The services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons

Explanation:

Single Source contract with Risk Solutions for the Exodis FMD and ECM due to the Supplier being the only provider of this key service. Although this initial requirement is below the PCR 2015 threshold for supplies and services (£139,688), the justification for single source under regulation 32 (2) (b) of the PCR 2015 for use of the negotiated procedure without prior publication is against reason ii) “competition is absent for technical reasons” – this is due to the Supplier holding the IPR and being the expert in this software that are necessary to the Environment Agency.
