WLHSCP has a responsibility to make provision for independent advocacy under the provisions of the Mental Health (Care and Treatment) (Scotland) Act 2003. To fulfil this responsibility and to promote social inclusion and equality, WLHSCP will commission services for the provision of a professional independent advocacy service which focuses on support to enable people with mental health problems and, or addiction issues to have their wishes heard, make their own choices and take control of their own lives.
In addition, under the terms of this contract additional spot purchase funding will be available for the duration of the contract for the provision of an independent advocacy service to unpaid adult carers.

It is a mandatory requirement of the contract that the provider is a full member of the Scottish Independent Advocacy Alliance (SIAA).
The service must be provided under the principals set out in the SIAA guidance
All Advocates must be fully qualified

Principles and standards for independent advocacy were published by the Scottish Independent Advocacy Alliance in 2008 and updated 2019 and by the Scottish Government in its Guide for Commissioners in 2013. They underpin the service to be provided.
The legislation that underpins advocacy services includes:
- Mental Health (Care and Treatment) (Scotland) Act 2003
- Adults with Incapacity (Scotland) Act 2000
- Adult Support and Protection (Scotland) Act 2007
- Equalities Act 2010
- Human Rights Act 1998
