seven.2) Information about modifications
seven.2.1) Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):
This relates to the variation of an existing contract. Proposed cost increases to the existing contract are attributable to the on-going increasing costs associated with transport and processing (eg fuel, particularly the move from red to white diesel, energy and staffing) which have been fuelled by Brexit and economies restarting following Covid. The Russia/Ukraine war has also exacerbated fuel and energy costs at a global level.
The contract allows for a further and final extension of 12 months from 31 July 2022 to 30 July 2023. The council are content that it is
reasonable to assume that contractors would not have foreseen the current cost increases in delivering services under the contract at
time of tendering.
This direct award is permitted by Regulation 72(1)(c) of the Public Contracts Regulations 2015
(c) where all of the following conditions are fulfilled:—
(i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen;
(ii) the modification does not alter the overall nature of the contract;
(iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.
