Section four. Procedure

four.1) Description

four.1.1) Type of procedure

Award of a contract without prior publication of a call for competition in the cases listed below

Explanation:

The Framework Agreement set out in OJEU Contract Notice was entered into by EANI as per the published Contract Award Notice (Framework Agreement).

Further additional services until the commencement of the new framework agreement, which were not included in the original procurement, have become necessary and are permitted by Regulation 72(1)(c) of The Public Contacts Regulations 2015. Namely, the following conditions have been fulfilled:

(i) The need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen. Namely, the Covid-19 pandemic. Due to Covid-19, the spend on this Framework has been higher than estimated. The Catering Service had to implement a classroom meal delivery service. To provide this service, they had to purchase items such as trolleys and gastronorm containers to serve the meals in the classroom.

Approval of this modification of value will allow for the continuation of this Framework to its natural end (31 August 2023). ;

(ii) The modification does not alter the overall nature of the contract; and

(iii) Any increase in price does not exceed 50% of the value of the original contract or framework agreement. The upper estimate of the original Framework Agreement was £846,000 GBP, with circa £725,000 GPB budget spent to date. As the extension is estimated to be up to a maximum of approximately £423,000 GBP, it does not exceed 50% of the value of the original Framework Agreement.
